1. Services
Momentum Marketing installs and manages custom lead conversion systems for businesses. Depending on the services selected, this may include conversion-focused websites and landing pages, custom CRM and lead management, automated SMS and email follow-up, missed-call text-back, appointment booking and reminders, call tracking and recording, website hosting and maintenance, and Meta and Google advertising management. The specific scope of work for each client is confirmed before services begin.
2. Eligibility
Our services are intended for businesses. You must be at least 18 years of age and have authority to act on behalf of the business you represent to purchase services.
3. Fees and Payments
- Implementation, monthly management, and advertising management fees are described on our Pricing page and confirmed with each client before work begins.
- Advertising spend and usage-based fees (such as messaging, email, phone minutes, phone numbers, and call recording) are separate from management fees unless otherwise stated in writing.
- Payment is due according to the terms agreed with each client.
4. Client Responsibilities
Clients are responsible for providing accurate business information, approvals, and access needed to set up their system, and for using the system in compliance with applicable laws. This includes obtaining appropriate consent before sending SMS or automated messages, honoring opt-out requests, completing carrier registration where applicable, and providing any required disclosures for call tracking and recording. Messaging functionality may be delayed until the required client information and approvals are complete.
5. No Guarantee of Results
Our goal is to build the infrastructure, follow-up, tracking, and marketing process that gives your business a stronger chance to convert opportunities. We do not guarantee any specific number of leads, booked appointments, revenue, rankings, or advertising results. Results depend on many factors outside our control, including your market, offer, budget, and how your team responds to leads.
6. Refunds
Because implementation work is custom to each client, fees for work already performed are non-refundable unless otherwise agreed in writing.
7. Limitation of Liability
To the fullest extent permitted by law, Momentum Marketing Agency is not liable for any indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities, arising from the use of our website or services. Our total liability for any claim related to our services will not exceed the fees paid to us for the services giving rise to the claim during the three months before the claim arose.
8. Governing Law
These Terms & Conditions are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in McLennan County, Texas.
9. Changes to Terms
We may update these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date.
